Olympic Athletes’ Hub – Terms of Service
Welcome to the Olympic Athletes’ Hub! Please read these Terms of Service carefully.
By accessing or using the Olympic Athletes’ Hub website (available at www.olympic.org/athleteshub and www.hub.olympic.org), the Olympic Athletes’ Hub mobile application or any other platform or media through which the Olympic Athletes’ Hub content may be accessible (together, the “Olympic Athletes’ Hub”), you agree to be bound by the terms described herein, including any policies incorporated by reference (together the “Terms”). Please do not use the Olympic Athletes’ Hub should you not agree with these Terms.
The Olympic Athletes’ Hub is made available to you by the International Olympic Committee, located at Château de Vidy, 1007 Lausanne, Switzerland (the “IOC”). These Terms constitute an agreement between you and the IOC governing your access and use of the Athletes’ Hub, and do not alter in any way the terms or conditions of any other agreement you may have with the IOC.
2. Eligibility and Registration Process
Access and use of the Olympic Athletes’ Hub is open to all persons who are at least 13 years old subject to their compliance with the Terms.
Certain Content and functionalities of the Olympic Athletes’ Hub require a successful registration with the Olympic Athletes’ Hub and the creation of a user account. The creation of an “Olympian account” is open only to persons having competed in at least one edition of the Olympic Games (Games of Olympiad or Olympic Winter Games) and may be subject to additional rules. You agree that registration and creation of a user account (including of an Olympian account) are subject to the discretionary decision of the IOC.
The IOC reserves the right to terminate your user account and access to the Olympic Athletes Hub, or remove any of Your Content (as defined below), at any time and without prior notice, for any reason, in particular in case you violate the present Terms.
3. Social media aggregator
The Olympic Athletes Hub aggregates publicly available content originating from accounts of Olympians on third party social media services such as Twitter, Facebook and Instagram. Users having successfully completed their registration with an Olympian account are given the option to allow the Olympic Athletes Hub to aggregate information they make publicly available on third party social media services. Any person whose social media accounts are featured on the Olympic Athletes Hub may contact the IOC at email@example.com, or through the “Contact the IOC” functionality of the Olympic Athletes Hub in order to have their social media public profiles or any other personal information removed from the Olympic Athletes Hub.
4. Collection and processing of users’ personal information
“Content” refers to any content and information accessible through the Olympic Athletes’ Hub including, without limitation, any text, graphics, data, photographic images, moving images, sound, illustrations and software.
a) IOC’s Content
You agree that the Olympic Athletes’ Hub, including any Content other than Your Content (as defined below) and Content made available by other users, is owned by the IOC, or licensed to the IOC by the respective rights owners (the «IOC Content«). The IOC Content is protected by copyright, trademarks, patents or other proprietary rights and laws and all rights not expressly granted to you under the present Terms are reserved.
The IOC grants you a limited, non-exclusive, revocable, worldwide, royalty-free license to access the IOC Content and use it in compliance with the present Terms and for your personal and non-commercial use. In particular, you must not attempt to distribute, commercialize, transmit, license, copy or lease any IOC Content or other Users’ Content without the IOC’s or such user’s prior respective authorization.
b) Your Content
You retain all ownership rights, and are solely responsible for, any Content you upload or in any manner make available on, or through, the Olympic Athletes’ Hub (“Your Content”).
You grant the IOC a non-exclusive, royalty-free, worldwide, transferable, license (with a right to sublicense) to use, reproduce, display, distribute, make available and prepare derivative works of Your Content, in whole or in part, in any media formats and through any media now known or to be known, in connection with the Olympic Athletes’ Hub and the promotion of the Olympic Movement. You also grant each user of the Olympic Athletes’ Hub a non-exclusive, royalty-free, worldwide license to access Your Content through the Olympic Athletes’ Hub and to use it in accordance with the functionalities of the Olympic Athletes’ Hub and the present Terms. All licenses granted to the IOC and the users of the Olympic Athletes’ Hub in relation to Your Content shall last for as long as Your Content remains available on the Olympic Athletes’ Hub and shall terminate within a reasonable time after you remove or delete Your Content from the Athletes’ Hub.
c) Content originating from third party services
Any Content accessible on the Olympic Athletes Hub and originating from third party social media services remains the property of its author and subject to the terms of service of the applicable third party service.
6. General Conditions of Use
The IOC grants you the permission to access the Olympic Athletes’ Hub and its Content in accordance with the present Terms and under the following conditions:
a) You guarantee that you dispose of the necessary rights and/or authorizations to make Your Content available on the Olympic Athletes’ Hub and that Your Content does not infringe upon the proprietary rights of any third party;
b) You may not, under any circumstance, alter or modify or circumvent any component of the Olympic Athletes’ Hub, or attempt to do so, or encourage or assist any other person to do so;
c) You may not launch, or upload or attach files that contain, any automated system having the purpose or effect to detrimentally affect the Olympic Athletes’ Hub;
d) You may not copy or imbed the IOC Content, unless authorized by the terms of service of the third party social media services from which the content originate and for that content only;
e) You may not collect any personal data, including account names, from the Olympic Athletes’ Hub;
f) You may not use the Olympic Athletes’ Hub for commercial or advertising purposes, or in any manner implying an association between a third party, or a third party’s product and services, and the IOC, its affiliated entities or the Olympic Movement, without the prior written consent of the IOC;
g) You may not upload or post any Content that is unlawful, racist, or otherwise contrary to the Olympic values, as expressed in the Olympic Charter. You may not use, or attempt to use, the functionalities made available to you on the Olympic Athletes’ Hub to commit any unlawful act or to defame, harass or impersonate other users.
You agree to the following:
a) Your use of the Olympic Athletes’ Hub shall be at your sole risk, and you are responsible to ensure that it is compliant with applicable laws. You are not allowed to use the Olympic Athletes Hub if such use contravenes with any law or regulation of your country of residence.
b) The IOC disclaims all liability for losses and/or damages caused by any unauthorized use of your user account. It is your responsibility to immediately notify the IOC of any breach of security or unauthorized use of your user account.
c) Despite the IOC’s efforts to provide accurate information and to prevent disruption caused by technical problems, the Olympic Athletes’ Hub may contain technical mistakes, inaccuracies or typographical errors.
d) Your use of the Olympic Athletes’ Hub requires one or more compatible devices, internet access and certain hardware and software and may require obtaining updates or upgrades from time to time. You agree that your ability to use the Olympic Athletes’ Hub may be affected by the performance of such materials, and that such system requirements are under your responsibility.
e) The Olympic Athletes’ Hub, including all Content, is provided to you “as is” and, to the fullest extent permitted by applicable law, the IOC, its officers, directors, employees and agents, disclaim all warranties, such as but not limited to warranties of availability, fitness for a particular purpose, and non-infringement of any applicable law or regulations, in connection with the Olympic Athletes’ Hub, its Content (including any link to any third party websites, and any offer of service or product made by third parties) and your use thereof. The IOC reserves the right to modify, improve, update, suspend or terminate any functionality of the Olympic Athletes’ Hub or its Content, at any time and without notice.
f) Links provided on the Olympic Athletes’ Hub to third party websites or platforms, or to offers for third party products or services, shall not be interpreted as a recommendation or endorsement by the IOC.
g) Although the IOC makes its best efforts to reply to any questions asked or request made through the Olympic Athletes’ Hub in a timely manner, the IOC does not guarantee any specific turnaround time, and the IOC reserves the right to refrain from answering any communication which does not comply with the present Terms.
h) The Olympic Athletes Hub will include Content from third parties (including Olympic athletes), who may express their own views on certain matters or events. These views which are not necessarily shared by the IOC and, while the IOC will use its best efforts not to display any content that is unlawful, racist, or otherwise contrary to the Olympic values, the IOC does not endorse, and disclaims all liability in relation to, the views expressed by such third parties.
8. Limitation of Liability
You agree that the IOC, the IOC’s officers, directors, employees or agents, and the IOC’s affiliated entities and subcontractors, shall not be liable for damages of any kind arising out of or resulting from:
i. the Content, your access to or use of the Olympic Athletes’ Hub and any Content, or of the websites linked to the Olympic Athletes’ Hub or its content;
ii. any conduct of any user of the Olympic Athletes’ Hub;
iii. any unauthorized access to or use of the IOC servers and/or any personal information or other information stored therein;
iv. any errors or inaccuracies in the Content;
v. any delays, interruptions, failure, poor quality or limitations of any kind in transmissions to or from the Olympic Athletes’ Hub or in the delivery or in the performance of services offered on the Athletes’ Hub; and
vi. any bugs, viruses, or the likes which may be transmitted to or through the Olympic Athletes’ Hub by any third party.
You agree to defend, indemnify and hold harmless the IOC as well as the IOC’s officers, directors, employees, agents, affiliates and subcontractors, from and against any claims or damages (including legal fees) arising in relation to your violation of the present Terms or more generally your use of the Olympic Athletes’ Hub. This defense and indemnification will survive the present Terms and your use of the Olympic Athletes’ Hub.
No action of the IOC, other than written waiver or amendment, may be construed as a waiver or amendment of these Terms. If any provision of these Terms is found invalid or unenforceable, the remainder of these Terms shall remain valid and enforceable to the fullest possible extent under applicable law.
Some informational Content made available by the IOC on the Olympic Athletes’ Hub may be provided to you in a language other than English. Such Content is a translation from English and is provided to you for your convenience only. In case of any discrepancy between the translated Content and its original English version, the latter shall prevail.
The present Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by the IOC without restriction.
11. Governing Law and Arbitration
The present Terms shall be governed and interpreted by the laws of Switzerland, without reference to its conflict of laws. Any dispute arising from or in connection with the execution or interpretation of these Terms or breach thereof which cannot be settled amicably, shall be submitted to the exclusive jurisdiction of the Courts of Lausanne, Switzerland.
